Town & Country Planning issues can have a major impact on the rural neighbourhood character, charm and amenities for the residents of South Drive or South Close.

 

One of the objects of the SDRA, as set out in its Memorandum and Articles of Association, is to to review and approve (with or without conditions) or oppose the construction and erection of new houses, extensions and other building works on land enjoying rights of way over South Drive and/or South Close. In practice, the SDRA focuses on planning applications that may breach one of the restrictive covenants.

 

Where a transgression of a restrictive covenant is contemplated, the SDRA Management Committee will decide whether to oppose or to offer a formal or informal waiver of the covenant, regardless of planning approval (the planning process conducted by local authorities does not take account of private covenants). From time to time the SDRA has become involved in planning issues. We avoid commenting on planning issues where restrictive covenants are not involved, or getting involved in disputes between neighbours except where the parties ask for the SDRA’s help in a mediating capacity to enable them to reach an amicable resolution.

 

Residents are reminded that the SDRA owns the freehold of the verges alongside South Drive and that South Drive lies within the Murdoch Road Conservation Area. Although residents of South Drive are responsible for maintaining the verges fronting their properties, all trees in the verges require consent, of both the SDRA and the Local Authority, before serious tree work is carried out.
